My sister is currently being sued by the government. Has anyone ever heard of this? It is right before the ten year mark on her loan.

This EXACT thing happened to me this past year.
My student loans are in default, and are 6 years old. I make a payment monthly, it is not much, but because it went into collections, I also have half of my income tax taken until paid in full.
Until this year, when they took 100% of my tax refund.
I went asking questions, and it was because of my student loans.
Yey.

Will the new Conservative government be able to delay or do anything to prevent the new law from coming into effect?

I think Bob's right on the nose here. I have experienced the similar situation this year. I've always made monthly payments on both my federal and provincial loans, albeit a pittance. I've never had my loans (even when they were in collections, for the last, oh, five years!) impact my income tax return ... until this year.

I'm eligible for approximately $1,800 in refunds, and was informed I'll be getting nothing. And, in other years, I've recieved up to $2,800 in refunds, with no confisicating.

So what's up with that?

Personally, if this legislation doesn't go through soon, I'm going to have a nervous breakdown. I was told about this in October when I went to see a bankruptcy trustee; she told me this was truly the only option for me ... how sad is that? Yet I'm still paying about $200 per month, when I'm the sole breadwinner for a family of four, with an income of $2,100 per month.

Ugh.

Anyway, I agree with Bob's theory 100%.

cait
